Constitutional Court to review Election Law

The Constitutional Court of Mongolia will consider a dispute on whether certain provisions of the Law on Parliamentary Elections violates the Constitution on April 22.

The complaint is regarding Article 6.1 and Article 72.1 of the Law on Election.

Particularly, Article 6.1 of the Law on Parliamentary Elections stipulates, “A political party that was registered to the Supreme Court before the announcement of an election will be able to participate in the elections and nominate its member who meet the requirement”, and Article 9.1 of the law states, “Parliament will announce the elections before February 1 of the election year.”

However, Article 26.1 states, “Parties and coalitions will submit their applications to participate in the election to the General Election Commission at least 60 days before the polling day”.

Article 28.3 states, “Parties and coalitions that meet the following requirements will be registered”, and Article 28.3.1 states, “Parties and coalitions will have been registered to the Supreme Court before the deadline for expressing its participation in the election in accordance with this law”.

These provisions reportedly specify conflicting timelines for political parties competing in elections to announce their participation.
